Who said anything about right? It rather undermines the Rovers' claim that they were treated unethically, though. Some might use the word 'karma'.

 

Same difference. you are suggesting that the episode with Bristol Rugby was a bad episode in the history of Rovers; I know too little about that to comment. What I am saying is i would not take glee for such a 're-balancing of fortunes' . I know many do and that is their opinion and thats perfectly fine .. i am merely pointing out the social issue here.

I find it a bit strange those on this forum who are perfectly happy to slate big business against the little man; the socialist struggle so to speak much of that argument, in principle, being admirable even if the tenet of the politics I might not agree with... ie if Socialism worked it would be perfect so to speak.. Only to then take great glee in such a behemoth crushing the little guy: Sainsbury over a Football Club. Just find that a tad sad and hypocritical.. not saying anyone in particular but there are fans on this forum who might just wish to ponder on that.

 

A Rovers spokesman:-

 

"We consider that Sainsbury's acted in bad faith and did their utmost to stall the purchase at every possible juncture. For instance, the Judge found that Sainsbury's could and should have engaged with local councillors and objectors during the planning process and kept the club informed of progress, which they did not do. "

The strongly worded statement went on: "The way in which Sainsbury's has conducted itself, repeatedly pledging its public support to the project (not only to the club but also to local MPs and Councillors) having already privately decided to pull out, encouraged the Club, UWE and both Bristol City and South Gloucestershire Councils to expend significant amounts of time and energy in connection with the plans to build the new stadium and ultimately left the club with no option but to sue Sainsbury's to keep this plan alive.

So its OK, for some, that a major Bristol public sector employer, Council, and a private business expended millions in man hours and cash only for it to be squashed by a ruthless PLC just so one can gloat.?

 

Its fine to poke a bit of fun, we all know that, but stop and think for a moment.. this is a bad and a sad day for what is fair and just in every sense of the word.

Squashed by a ruthless PLC? Sainsburys won fair and square in a court of law on a point of law.

Technically yes. In every other sense, whichever way you look at it no.. but it entirely misses the crux of my post which is about big boy crushing the little guy and how, usually, a football fan will abhor that happening. That is ALL i am getting at. 

 

Let me put it another way.. If Rovers had lost a fair fight i would have been broadly neutral and said.. hard luck, better luck next time.. thats just me. 

 

I think why a lot of City fans take glee without considering the wider picture is because of what Aizoon and some others mention ref the Rugby debacle and because Higgs seems to be a bit of a hate figure. That in today's world is fair enough.

I do see your point in principle, however you are quoting the BRFC version of events, a position that is constantly being undermined by the facts. It's important to note that Sainsburys deny this and more importantly the Judge does not agree with the Rovers on this.

No technically about it, sainsburys won fair and square,

The bone of contention rovers had was about the s.76 that the gas themselves had to agree too before it was submitted,

They are also guilty of trying to change the contract in regards to the cil

No matter how much rovers and Higgs dress it up, sainsburys were not the bad guys if anything it was rovers for trying to hange agreed terms, sainsburys have done nothing wrong and all this bad faith is nothing but bullshit from poor losers

If they appeal they will lose as the judgement isn't floored

Tosh - via delegation The Authority could have provided the necessary planning consents, either first time around or via the variation application.

Nice one Baron - stitched-up The Gas and reinforced your easy earned reputation to boot. Perhaps like a Hammer movie of yore College Green will see hoards of flame carrying simpletons looking to exact revenge on The Monster.....

Havana, this isn't a story of naughty Mr Sainsbury's and his orange van turning up outside the clubhouse of the local parish team and offering to buy them a stand or two and then dropping it at a time of his choosing.

For starters Higgs and most of the R*vers board have made vast sums of money in the construction industry, they know how these things work and have the financial clout to rule out them playing the 'little guy' card now it has gone against them. Both sides went to great expense to get lawyers to draft a complicated document to which both sides AGREED. It seems this was poorly drafted but that is irrelevant, both sides had plenty of chances during negotiations to protect themselves and get what they wanted.

One of those agreed terms gave both sides the right to terminate under certain scenarios to protect both sides. As it happened, it protected Sainsbury's and the court said they were within their rights to terminate.

This is not about big business v the little guy. That battle was won when TRASHorfield lost. Had a new Sainsbury's been built that would have been the big PLC putting the little guys out of business.

Instead, this was two experienced sides coming to an agreement for a lot of money (but not so big compared to each side's financial muscle) with complicated terms and conditions. They knew what they were doing but they got it wrong and lost. There is no socialist sob story to this.

I actually loathe Sainsbury's.  I loathe their horrible wet bacon, their overpriced veg., their buy two or be overcharged if you buy one policy, their piss-poor wine, the way they bully check-out staff to process more customers per hour, their attitude to suppliers, the fact that they are one third owned by Qatar................but.....................I loathe the Gas even more!

Abso****inglutely, no gas chairman in my 40 odd year of following Bristols' oldest unbroken league team has given me so many laughs, long may it continue.

I enjoy these situations because it's Rovers and they'd be exactly the same if it was us, it's broadly better for us if they fade into nothingness and City continue to improve.

Anything major that hinders them like this helps us, although you can't beat a Bristol derby atmosphere.

In this instance Sainsbury's were not compelled to make an appeal (it seems) unless Counsel opined they had a 60% chance of success. That's part of the Sainsburys deal.

And as the judge highlighted The Big Bad Wolfy Supermarket did appeal (though they thought no chance of gaining approval) and moreover did so with the wholehearted approval and consent of The Gas. Therein, as the judge points out, lay the discharge of that particular obligation.
