bristolcitysweden Posted July 16, 2019 Report Share Posted July 16, 2019 If there is a causation between your acting and the outcome of it and it's legislated as a criminal act by the politicians the police by law has to report any suspected breach of the law for the court to decide. It would ultimately be for magistrate / judge as appropriate to decide whether one gets granted at sentencing hearing once someone’s convicted. If someone pleads guilty at first opportunity for example then they might adjourn for pre-sentence reports to be completed on the individual if appropriate at which point the CPS may apply for / recommend a banning order as part of the sentence (following consultation with officer dealing with case / football liaison officer I imagine). If a case is likely to be guilty plea at first hearing then a football banning order application may be part of the file sent to court already - may be wrong about that through. Definitely the football banning order thing seems overdone though, both in absolute numbers and the range of offences- some and maybe more are a nonsense. Unless you're absolutely guilty and you know it, FSF Faircop, Amanda Jacks is a good starting point. Well I say FSF Faircop, Twitter handle is @FSA_Faircop now. I don't believe exactly but I think there's free initial legal advice. She's a caseworker and can refer to Football Specialist lawyers, law firms- with expertise in football specific legislation. You have a job to do i understand that, i just don't agree with the way things are done and even more so the way you suggest that it is little to do with you and more the court. The be all and end all is that if as a fan you avoid putting yourself in the situation then you wont face a ban but i do believe they are handed out way to easily and i still stand by the claim that the police benefit financially from banning orders and that you make an estimate of how many you think will be handed out/applied for by your team and budgets are based partly on that but im sure you will say im wrong ..no problem its a forum for discussing football stuff and banning orders are football related especially with the way they are being handed out to city fans lately ... not to mention harsh sentencing but thats not on you at all that ones on Magistrate Matthews !
