The QC appointed to hold the village green application review, was appointed by Bristol City Council. It just so happens that, she had "NEVER" found against an application for a village green. Makes one wonder why she was appointed and, who recommended her.

Ms Ross Crail, the "independent" Inspector appointed to deal with the village green application was a lawyer who specialises in advising people on how to apply for village green status.

It was not her job to make a decision.  However, she did make recommendations and it was down to the council to implement them or not. She recommended that the whole 42 acres of the site should be registered as a village green but the council only wanted to register 17 acres.  As a result it went to the High Court under Judicial Review.

To have planning refused where it was previously granted is as close to automatic right to JR as you're likely to find though. All moot I'm sure, can't imagine they wouldn't get PP.

It is possible for planning permission to be refused when previously granted.  It is unlikely that the application will be the same and planning policies may have changed since the original decision.

That isn't how planning or the legal system works.  Precedent doesn't come into planning.

The council are perfectly within their rights to arrive at a different decision even if the application was exactly the same because many other external factors could be different.

The only appeal is a judicial review and for that to succeed it has to be shown that there was something wrong with the decision in a very narrow set of criteria based on the procedure applied not the actual decision.

Even if you win a judicial review it doesn't mean you get the decision you want, the court could simply direct the council to make the decision again.

There is a right of appeal if a planning application is refused.  The appeal would be heard by a Planning Inspector, unless called in by the Secretary of State.

If the Inspector dismisses the appeal a judicial review would only be considered if there is evidence that the decision is unlawful, for example, if the Inspector has failed to take in to account a material consideration.  You cannot apply for a judicial review just because you do not agree with a decision.

  4. So true. But how a player, like I said, gave it away numerous times in the 2 nd half and put the rest of his team mate under pressure was award MOM is baffling to me.

Fontaine was immense and would of got the MOM from me.

As I said in my earlier post - opinions are subjective. More often than not we only see what we want to see and not what we should see.

Prior to him signing for City, if you would have asked City fans for their opinion of Norman Hunter, the majority would have said he was nothing but a dirty clogger. Most people's preconceptions would have initially clouded their judgement. However, in reality, and as City fans came to recognise, he was anything but just a dirty player. He was very skilful and had a sweet left foot.

Perhaps the Mirror reporter, as a a neutral, approached the match with an open mind about the players on both sides. Perhaps, like you, he saw LJ give the ball away a few times but perhaps he also saw him do more positive things than you have given him credit for because he never had any pre-conceived ideas or was not looking to pounce on the slightest error.

  5. Orr was shocking in the second half and got away with it on numerous occasions, to give him 8/10 is very generous. I'd of given him 6/10

Lee Johnson was also very poor second half and lost the ball in dangerous postions on numerous occasions by trying fancy dan passes rather than just keeping it simple. It doesn't get mentioned because nothing came of it but ion another day it would of cost us a goal. 6/10

Other than that top day out :bounce:

Just to show how subjective opinions and ratings can be. LJ was MOM in Sunday Mirror.

  6. My bro is flying in from Anguilla to see the City promoted. Now, he comes home about once a year but this is not a scheduled visit so that, in my book, is pretty dedicated stuff.

The distance into Bristol Airport, if he could fly like a crow, would be 3,974.89 miles one way. However, he has to go via Newark which is a lot more obviously.

But, for the sake of this little bit of fun we shall leave it as the direct crow flies distance.

Is there any expat out there that can top that? If so, he/she deserves a medal.

    Come on u redddssssssssssssssss.

there is no cup for coming.... :winner_third_h4h:

Irony is that he got here before his tickets. :grr:

Wonder how many air miles they clocked up?

  7. The man  was  the  greatest  ever  Englishman,  who  could  have shown  our  current politicians  a  thing or  two  about  honesty, integrity and  faith.

Long  may his  glorious  soul grace  Gods  company!!

(Geoff Merrick  is  a  close  second in  the  greatest Englishman stakes ofcourse.)

    :D

Not sure that the Irish would agree (about Cromwell, not Geoff Merrick). Cromwell was responsible for the deaths of one third of the Irish population, either through massacre or starvation.

  8. Fred Ford's side of 64-65.

Came from nowhere (near the foot of the table in February) with a late run. Fired on by Big John Atyeo's goals they clinched promotion on the last day of season.

Strangely enough the team they beat on the last day in 65 was Oldham.

  9. Oh come on!  Not this over confidence again!  I thought you would have learned from saturday that a team missing key players is not one to lie down and die.  Wednesday beat us with a reserve team out.
    Exactly.

We need to watch McSporran. Always seems to score against us.
