Guest Posted March 1, 2012 Report Share Posted March 1, 2012 As it's only a decision it will be a fairly quick process, I would imagine news reporters will leave court the minute something is decided and it'll be on twitter quicker than Ivan Sproule in the pre season 100 meter dash. Given the way this season has gone I am naturally pessimistic and fully expect this to be rubber stamped leaving us staring into the abyss of another couple of years before we can even begin to think about starting, and that's assuming we win in the end. I assume if it was, by some bizarre miracle, overturned, that they would no doubt have umpteen other rights of appealing their failed appeal at a timescale of yet more months? I realised about a year back that the mythical final obstacle is actually only the gateway to the next avenue of appeal. There are a few reasons to be confident about tomorrow. - We have a top (and no doubt v expensive) QC representing BCC and the landowner who is a specialist in these matters - The judge has said he is 'minded' to accept the original applicant's withdrawal letter, and; - The campaigners argument appears weak, based on technicalities of the letters of withdrawal We shall see tomorrow... If the JR is granted and the council are found to have made a mistake it will be up to the council to decide what they want to do depending on the outcome. If the judge says yes too much weight was put on the evidence submitted post the original review then yes it's a possibility. I’ve often despaired of this saga ever coming to an end but when I read the Evening Post article I felt hopeful. Which is ironic really, bearing in mind that the whole basis of their JR case is about BCC not following legal technicalities. Sadly, however, it's legal technicalities that provide the basis for the nimbys being able to hold all this up for years more and I suspect that's what will happen. My worry is what happens when they've used the village green legislation to hold it up for so long that the planning consents expire. Doesn't that happen after 5 years - and we must be at least a year into that now. Will we have to start the whole planning process over again? It's really no wonder that the country is struggling to grow the economy when so many hurdles are put in the way of new houisng, new development, new industry etc - and interesting that Liam Fox keeps wittering on about growth but still opposes it when its on his doorstep. The problem is, with these delays, we could see a different make up of councillors at B.C.C. By the time another vote takes place, the council could have more anti stadium lid dems and greens.
