I genuinely do not understand why fans feel the need to win a bet and run on the pitch?? Second person I have dealt with this season who has done it. Yes exactly that, normally will get a ban for coming on the pitch if they have some form of public order/ football related offence history OR if the invasion led to an assault/ disorder towards other fans or players/ officials. It is absolutely down to the magistrates on the day of the hearing, and their belief that the defendant could contribute to violence or disorder again at any future games, it is in this belief that football banning orders are given. Please can you let me know how you would perceive the following circumstance : Away at Sheff Utd. Young lad, with absolutely zero previous criminal offences (in fact a thoroughly good kid who’s never been in trouble anywhere before, whether football or going through school or anything), happens to find himself on the pitch with the players when we scored our last minute winner. His actions were of pure joy, ecstasy and spontaneous happiness and were not of criminal intent nor was anyone harmed in any way. Would this type of incident lead to a ban? I’d hope that the police would be sympathetic enough to understand that an outpouring of sheer emotion is very different to an act of criminality and that perhaps they would have influence to not press charges and prevent such a trivial matter going to the magistrates. We then present the evidence to court and the decision to ban is made by the magistrate sitting that day. there is no consistency with the magistrates around the uk , so some will give football banning orders for this type of offence and some won’t. bristol magistrates recently didn’t give one for the Male that came on against derby who also joined in player celebrations however I know in other parts of the country magistrates have given them, so unfortunately there is no clear cut answer I am afraid . My advice as always to persons charged with any offence is to speak to a solicitor before any court date, everyone is entitled to free legal advice and there are some specialist football solicitors who will be able to help. The football supporters federation will be able to point you in the right direction. As previously stated with regards to this offence the law does not differentiate between joyous celebrations of last minute winning goals or something else altogether. It is clear the policy is for those who do it and get caught will be dealt with by us , and potentially worse case scenario a criminal record and a football ban , best case an offcial police caution and club ban for a certain amount of home games.
