Driving whilst disqualified would need to be fully backed up with DVLA/court evidence and may not be fully black and white mainly because of administrative errors, so sometimes is a grey area until all of the relevant hard copy evidence is in police hands. Theft in the UK is misappropriating property with the intention of permanently depriving the other. Unless Tammy was taking the car for keeps it wouldn't be theft. Their insurance does not allow them to drive any other vehicle. So whether banned or not he still would not have been insured. all drivers under 25 and their parents know this.
